Second trial

Gorgonova appealed against the sentence and in March 1933 her second trial took place. Her lawyer challenged the testimony of Stas Zaremba, especially since during the night of murder he recognized the figure as his sister and later, probably guided by the police, he became sure that he saw Gorgonova. Also parts of evidence were treated with little care by the police (like footprints in the snow or bloodstains). The pickaxe that was considered to be a murder weapon didn’t have any bloodstains and the investigators couldn’t prove that the wounds were done by that pickaxe.

In second trial Gorgonova was again found guilty, but this time she was sentenced to 8 years in prison - it was determined that she did committed the crime, but it was crime of passion. She was released from prison after 6 years because World War 2 has just broke out.

Until her death Rita Gorgonova never confessed to the murder of Elzbieta Zaremba.
